Possession of Firearm by Felon and Drug Charges Dismissed

December 2021

Our client was indicted in 2019 in Catawba County Superior Court for Possession of Firearm By Felon and Felony Maintaining or Keeping a Dwelling for Controlled Substances. Mr. Webster filed a Motion To Suppress the search of the client’s home and based upon the merits of the Motion, the Assistant District Attorney dismissed the charges in December of 2021.

April 2018

April 2018, our client, indicted for Trafficking in Methamphetamine in Catawba County Superior Court and facing 18 and a half years in prison, had his case dismissed

Felony Charges Dismissed

November 2021

Our client was indicted in 2019 in McDowell County Superior Court with the felonies of Discharging a Firearm from Within an Enclosure and Possession of Firearm By Convicted Felon. Mr. Webster filed a Motion To Suppress evidence in connection with the statements that our client made about the case to the arresting officer. The Motion was heard and argued in McDowell County Superior Court and the judge granted the Motion and all the client’s charges were dismissed.

Client Charged with Serious Murder-Related Charge Gets a Probationary Sentence

October 2021

Our client was charged in September 2019 with Accessory Before the Fact to Murder, a felony that carries a punishment of life imprisonment. In October of 2021, Mr. Webster was able to get a plea to Attempt To Obstruct Justice and the client received probation.

Not Guilty Verdict in Sexual Battery Case

October 2021

Our client was charged with Sexual Battery in 2021 in Burke County District Court. After a half-day bench trial in district court in October 2021, the judge found our client “Not Guilty.”

Not Guilty Verdict for Driving While Impaired Charge

July 2019

Our client was charged with Driving While Impaired on August 2017 in Burke County District Court. After a bench trial in district court in July 2019, Mr. Webster was able to get our client a verdict of “Not Guilty.”

Bench Trial Finds Client Not Guilty of Possession of Marijuana

September 2018

Our client was charged with Possession of Marijuana less than a half ounce in October 2017 in Burke County District Court. After a bench trial in district court in September 2018, Mr. Webster was able to obtain a verdict of “Not Guilty.”

Our client was indicted in Burke County Superior Court with Habitual Impaired Driving in October 2018, and had his case dismissed in June 2019.

Dismissal of Multiple Indictments and Plea to Misdemeanor

July 2019

Our client was indicted in September 2018 in McDowell County Superior Court with Possession of Methamphetamine and being a Habitual Felon. This same client was indicted in November 2018 in Burke County Superior Court with Possession of Methamphetamine and being threatened with a Habitual Felon indictment if he did not take a plea in Burke County and receive an active prison sentence. After Mr. Webster filed a Motion To Suppress evidence in connection with the search of the client’s vehicle in McDowell County, all charges were dismissed in May 2019. A similar Motion was filed by Mr. Webster in Burke County that resulted in our client receiving a plea to a misdemeanor charge and a probationary sentence with no jail time in July 2019.

Judge Dismisses Driving While Impaired Charge After Officer’s Testimony

April 2019

Our client was charged in Burke County with Driving While Impaired after refusing to blow in the machine that officers use to measure blood alcohol content, and then having his blood drawn which showed his blood alcohol content was .236, which is almost three times the legal limit. After the officer testified at trial, Mr. Webster was able to convince the judge that the officer that stopped our client’s vehicle did not follow the law and therefore the charge was dismissed.

Jury Finds Client Not Guilty

March 2019

Our client was indicted in Burke County with possession of methamphetamine after an officer found marijuana in his pocket and a pack of cigarettes in the driver’s door of the car our client was driving. The pack of cigarettes had a plastic bag of methamphetamine stuffed inside. Additionally, the officer found an identical pack of cigarettes in our client’s pocket and a methamphetamine pipe in the center console of the vehicle. After a one-day jury trial, Mr. Webster was able to convince the jury that our client was not guilty and this saved our client from having a felony on his record.

Habitual Felon Freed from Custody

May 2018

Our client was indicted in Catawba County with felony larceny and being a habitual felon after being caught on video removing anti-theft devices from clothing and then removing the clothing from a department store. Due to these charges he was facing up to 10 years in prison. After a three-day jury trial in May of 2018, Mr. Webster was able to convince the jury that our client was only guilty of a misdemeanor larceny and our client served no additional jail time.

Felony Death Plea Reduced to Misdemeanor

November 2018, our client was charged in Burke County with Felony Death By Motor Vehicle and Felony Serious Injury By Motor Vehicle which was due to an alleged impaired driving accident that caused the death of one person and the serious injury of another. Our client was facing up to 10 years for each charge due to the potential of being found to be a habitual felon. Our client pled guilty to Misdemeanor Death By Motor Vehicle and received a 150 day sentence.
